Mind Shift - Feedback & Research Survey — Terms & Conditions

1. About the Survey

The Mind Shift Feedback & Research Survey has been created to understand people's experiences, expectations and needs relating to mental fitness, emotional wellbeing, workplace stress, mental workload and supportive conversations. The purpose of this survey is to support Mind Shift's research, development and improvement of its future services and programmes. Participation in this survey is voluntary.

2. Purpose of Information Collection

Information submitted through this survey may be used for: Research and market understanding, understanding mental-fitness and workplace wellbeing needs, identifying common challenges and areas of concern, developing and improving Mind Shift services, designing future mental-fitness programmes and workshops, measuring interest in workplace wellbeing initiatives, analysing general trends and patterns, improving the participant experience. Where appropriate, information will be analysed in aggregated or anonymised form.

3. Information We May Collect

Depending on the questions included in the survey, Mind Shift may collect information such as: Name, if voluntarily provided, Company or organisation name, General demographic information, Job role or department, if provided, Responses relating to mental fitness and wellbeing, Experiences relating to workplace pressure or stress, Opinions, feedback and suggestions regarding Mind Shift. Phone number and email address are not required for participation in this survey. Participants are encouraged not to provide unnecessary personal information in free-text responses. Please do not provide passwords, financial information, Emirates ID details, medical records, or other information that is not specifically requested by the survey.

4. Voluntary Participation

Participation in the survey is completely voluntary. Participants may choose not to answer optional questions and may leave the survey before submission. Participation or non-participation will not affect a person's employment, relationship with their employer, or access to any existing service.

5. Mental Fitness Disclaimer

The questions contained in this survey are intended solely to understand general experiences and perceptions relating to mental fitness and wellbeing. This survey is not a psychological, psychiatric or medical assessment. The survey does not: Diagnose any mental-health condition; Provide a clinical assessment; Provide medical advice; Prescribe treatment; Replace professional mental-health or medical support. Any responses or results obtained through this survey should not be interpreted as a diagnosis or professional assessment.

6. Mind Shift Service Scope

Mind Shift's concept is based on mental fitness, guided listening, emotional support and wellbeing. Mind Shift does not intend for its general listening or mental-fitness activities to replace appropriately qualified and licensed healthcare or mental-health professionals. Where an individual's needs appear to fall outside the scope of Mind Shift's services, Mind Shift may recommend seeking appropriate professional assistance.

7. Privacy and Confidentiality

Mind Shift respects the privacy of participants and will take reasonable measures to protect information submitted through the survey. Information will be handled in accordance with applicable UAE laws and the Mind Shift Privacy Policy. Participants should understand that no online system or electronic transmission can be guaranteed to be completely secure. Confidentiality may be subject to circumstances where disclosure is required or permitted by applicable law.

8. Use of Research Findings

Mind Shift may analyse responses to identify general trends, patterns and insights. Where survey findings are used in: Reports, Presentations, Research materials, Educational content, Company proposals, Workshops, Marketing or communication materials, Mind Shift intends, where appropriate, to use aggregated or anonymised information so that individual participants are not identified. Mind Shift will not intentionally publish a participant's identity or identifiable personal response without an appropriate legal basis or consent where required.

9. Employer / Company Privacy

Where this survey is distributed through an employer or company, participation does not automatically mean that the participant's individual responses will be shared with the employer. Where results are provided to an organisation, Mind Shift intends, where appropriate, to provide aggregated or anonymised findings rather than identifiable individual responses. Participants should, however, understand that complete anonymity cannot always be guaranteed if they voluntarily provide identifying information or information that could reasonably identify them.

10. Data Protection

Mind Shift will collect and process personal information in accordance with applicable UAE data-protection laws. Mind Shift aims to: Collect information only for legitimate and specified purposes; Collect information that is reasonably necessary for those purposes; Take reasonable measures to protect information from unauthorised access, loss, misuse or disclosure; Retain information only for as long as reasonably necessary for the relevant purpose or as otherwise required or permitted by applicable law. 11. Participant Rights

Subject to applicable UAE law, individuals may have rights concerning their personal information, including rights relating to access, correction, updating, deletion or other forms of control over their personal data. Mind Shift may need to verify the identity of the person making a request before processing it.

12. Emergency and Crisis Disclaimer

The Mind Shift Feedback & Research Survey is not an emergency or crisis-intervention service. The survey should not be used where a person requires immediate medical, psychological or emergency assistance. If a participant believes that they or another person are in immediate danger or at risk of serious harm, they should seek appropriate emergency or professional assistance immediately rather than relying on this survey or waiting for a response from Mind Shift.

13. No Professional Relationship

Participation in this survey does not create a: Doctor-patient relationship, Therapist-client relationship, Counsellor-client relationship, Professional healthcare relationship, Employment relationship between the participant and Mind Shift. The current survey is intended for research, feedback and service-development purposes.

14. Accuracy of Information

Participants are encouraged to provide honest responses. Mind Shift does not guarantee that survey findings will represent the views of the wider population, as participation is voluntary and the survey may not constitute a statistically representative sample.

15. Intellectual Property

The Mind Shift name, logo, branding, survey structure, questions, written content and other materials associated with Mind Shift are owned by or licensed to Mind Shift unless otherwise stated. No part of the survey or website may be reproduced, copied, modified or commercially distributed without prior written permission.

16. Changes to the Survey

Mind Shift may modify, suspend or discontinue the survey at any time. Mind Shift may also update these Terms & Conditions where reasonably necessary. The latest version will be made available on the Mind Shift website.

17. Governing Law

These Terms & Conditions shall be governed by the applicable laws of the United Arab Emirates. Any dispute arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the competent courts of the Emirate in which Mind Shift is legally established, unless otherwise required by applicable law.

مايند شفت - استبيان الملاحظات والبحث — الشروط والأحكام

1. حول الاستبيان

تم إنشاء استبيان مايند شفت للملاحظات والبحث لفهم تجارب الناس وتوقعاتهم واحتياجاتهم المتعلقة باللياقة الذهنية والعافية العاطفية وضغوط العمل والعبء الذهني والمحادثات الداعمة. الغرض من هذا الاستبيان هو دعم أبحاث مايند شفت وتطوير وتحسين خدماتها وبرامجها المستقبلية. المشاركة في هذا الاستبيان تطوعية.

2. الغرض من جمع المعلومات

قد يتم استخدام المعلومات المقدمة من خلال هذا الاستبيان من أجل: البحث وفهم السوق، فهم احتياجات اللياقة الذهنية والعافية في مكان العمل، تحديد التحديات الشائعة ومجالات القلق، تطوير وتحسين خدمات مايند شفت، تصميم برامج وورش عمل مستقبلية للياقة الذهنية، قياس الاهتمام بمبادرات العافية في مكان العمل، تحليل الاتجاهات والأنماط العامة، تحسين تجربة المشارك. حيثما كان ذلك مناسباً، سيتم تحليل المعلومات في شكل مجمع أو مجهول الهوية.

3. المعلومات التي قد نجمعها

اعتماداً على الأسئلة المدرجة في الاستبيان، قد تجمع مايند شفت معلومات مثل: الاسم، إذا تم تقديمه طوعاً، اسم الشركة أو المؤسسة، معلومات ديموغرافية عامة، المسمى الوظيفي أو القسم، إذا تم تقديمه، ردود تتعلق باللياقة الذهنية والعافية، تجارب تتعلق بضغط العمل أو التوتر، آراء وملاحظات واقتراحات بخصوص مايند شفت. رقم الهاتف وعنوان البريد الإلكتروني غير مطلوبين للمشاركة في هذا الاستبيان. يتم تشجيع المشاركين على عدم تقديم معلومات شخصية غير ضرورية في الردود النصية الحرة. يرجى عدم تقديم كلمات المرور أو المعلومات المالية أو تفاصيل الهوية الإماراتية أو السجلات الطبية أو أي معلومات أخرى لم يطلبها الاستبيان على وجه التحديد.

4. المشاركة الطوعية

المشاركة في الاستبيان تطوعية تماماً. يجوز للمشاركين اختيار عدم الإجابة على الأسئلة الاختيارية ويجوز لهم مغادرة الاستبيان قبل الإرسال. لن تؤثر المشاركة أو عدم المشاركة على وظيفة الشخص أو علاقته بصاحب العمل أو الوصول إلى أي خدمة موجودة.

5. إخلاء مسؤولية اللياقة الذهنية

الأسئلة الواردة في هذا الاستبيان تهدف فقط إلى فهم التجارب والتصورات العامة المتعلقة باللياقة الذهنية والعافية. هذا الاستبيان ليس تقييماً نفسياً أو طبياً. الاستبيان لا: يشخص أي حالة صحية نفسية؛ يقدم تقييماً سريرياً؛ يقدم نصيحة طبية؛ يصف علاجاً؛ يحل محل الدعم المهني للصحة النفسية أو الطبية. لا ينبغي تفسير أي ردود أو نتائج تم الحصول عليها من خلال هذا الاستبيان على أنها تشخيص أو تقييم مهني.

6. نطاق خدمة مايند شفت

يعتمد مفهوم مايند شفت على اللياقة الذهنية والاستماع الموجه والدعم العاطفي والعافية. لا تنوي مايند شفت أن تحل أنشطتها العامة للاستماع أو اللياقة الذهنية محل المتخصصين في الرعاية الصحية أو الصحة النفسية المؤهلين والمرخصين بشكل مناسب. حيث تبدو احتياجات الفرد خارج نطاق خدمات مايند شفت، قد توصي مايند شفت بطلب المساعدة المهنية المناسبة.

7. الخصوصية والسرية

تحترم مايند شفت خصوصية المشاركين وستتخذ تدابير معقولة لحماية المعلومات المقدمة من خلال الاستبيان. سيتم التعامل مع المعلومات وفقاً للقوانين المعمول بها في دولة الإمارات العربية المتحدة وسياسة الخصوصية الخاصة بمايند شفت. يجب أن يفهم المشاركون أنه لا يمكن ضمان أن يكون أي نظام عبر الإنترنت أو إرسال إلكتروني آمناً تماماً. قد تخضع السرية لظروف يكون فيها الكشف مطلوباً أو مسموحاً به بموجب القانون المعمول به.

8. استخدام نتائج البحث

قد تقوم مايند شفت بتحليل الردود لتحديد الاتجاهات والأنماط والرؤى العامة. حيث يتم استخدام نتائج الاستبيان في: التقارير، العروض التقديمية، المواد البحثية، المحتوى التعليمي، مقترحات الشركات، ورش العمل، المواد التسويقية أو الاتصالية، تنوي مايند شفت، حيثما كان ذلك مناسباً، استخدام معلومات مجمعة أو مجهولة المصدر بحيث لا يتم تحديد هوية المشاركين الأفراد. لن تنشر مايند شفت عن قصد هوية المشارك أو رده الشخصي المحدد دون أساس قانوني مناسب أو موافقة حيثما كان مطلوباً.

9. خصوصية صاحب العمل / الشركة

عندما يتم توزيع هذا الاستبيان من خلال صاحب عمل أو شركة، فإن المشاركة لا تعني تلقائياً أن ردود المشارك الفردية سيتم مشاركتها مع صاحب العمل. حيث يتم تقديم النتائج إلى منظمة، تنوي مايند شفت، حيثما كان ذلك مناسباً، تقديم نتائج مجمعة أو مجهولة المصدر بدلاً من ردود فردية محددة. ومع ذلك، يجب أن يفهم المشاركون أنه لا يمكن دائماً ضمان عدم الكشف عن هويتهم بشكل كامل إذا قدموا طوعاً معلومات تعريفية أو معلومات يمكن أن تحدد هويتهم بشكل معقول.

10. حماية البيانات

ستقوم مايند شفت بجمع ومعالجة المعلومات الشخصية وفقاً لقوانين حماية البيانات المعمول بها في دولة الإمارات العربية المتحدة. تهدف مايند شفت إلى: جمع المعلومات فقط لأغراض مشروعة ومحددة؛ جمع المعلومات الضرورية بشكل معقول لتلك الأغراض؛ اتخاذ تدابير معقولة لحماية المعلومات من الوصول غير المصرح به أو الفقدان أو سوء الاستخدام أو الكشف؛ الاحتفاظ بالمعلومات فقط طالما كان ذلك ضرورياً بشكل معقول للغرض ذي الصلة أو كما هو مطلوب أو مسموح به بطريقة أخرى بموجب القانون المعمول به.

11. حقوق المشارك

رهناً بالقانون المعمول به في دولة الإمارات العربية المتحدة، قد يكون للأفراد حقوق تتعلق بمعلوماتهم الشخصية، بما في ذلك الحقوق المتعلقة بالوصول أو التصحيح أو التحديث أو الحذف أو أشكال أخرى من التحكم في بياناتهم الشخصية. يمكن توجيه الطلبات المتعلقة بالمعلومات الشخصية إلى: مايند شفت، البريد الإلكتروني: contactus@mindshiftuae.com. قد تحتاج مايند شفت إلى التحقق من هوية الشخص الذي يقدم الطلب قبل معالجته.

12. إخلاء مسؤولية الطوارئ والأزمات

استبيان مايند شفت للملاحظات والبحث ليس خدمة طوارئ أو تدخل في الأزمات. لا ينبغي استخدام الاستبيان حيث يحتاج الشخص إلى مساعدة طبية أو نفسية أو طارئة فورية. إذا كان المشارك يعتقد أنه أو أن شخصاً آخر في خطر فوري أو معرض لخطر ضرر جسيم، فيجب عليه طلب المساعدة الطارئة أو المهنية المناسبة على الفور بدلاً من الاعتماد على هذا الاستبيان أو انتظار رد من مايند شفت.

13. عدم وجود علاقة مهنية

لا تؤدي المشاركة في هذا الاستبيان إلى إنشاء: علاقة طبيب-مريض، علاقة معالج-عميل، علاقة مستشار-عميل، علاقة رعاية صحية مهنية، علاقة عمل بين المشارك ومايند شفت. الاستبيان الحالي مخصص لأغراض البحث والملاحظات وتطوير الخدمة.

14. دقة المعلومات

يتم تشجيع المشاركين على تقديم ردود صادقة. لا تضمن مايند شفت أن نتائج الاستبيان ستمثل آراء عامة السكان، حيث أن المشاركة تطوعية وقد لا يشكل الاستبيان عينة إحصائية تمثيلية.

15. الملكية الفكرية

اسم وشعار وعلامة مايند شفت التجارية وهيكل الاستبيان والأسئلة والمحتوى المكتوب والمواد الأخرى المرتبطة بمايند شفت مملوكة لـ مايند شفت أو مرخصة لها ما لم ينص على خلاف ذلك. لا يجوز إعادة إنتاج أي جزء من الاستبيان أو الموقع أو نسخه أو تعديله أو توزيعه تجارياً دون إذن كتابي مسبق.

16. التغييرات في الاستبيان

يجوز لمايند شفت تعديل أو تعليق أو إيقاف الاستبيان في أي وقت. يجوز لمايند شفت أيضاً تحديث هذه الشروط والأحكام عند الضرورة المعقولة. سيتم إتاحة أحدث إصدار على موقع مايند شفت.

17. القانون الحاكم

تخضع هذه الشروط والأحكام للقوانين المعمول بها في دولة الإمارات العربية المتحدة. أي نزاع ينشأ فيما يتعلق بهذه الشروط والأحكام يخضع لاختصاص المحاكم المختصة في الإمارة التي تأسست فيها مايند شفت قانوناً، ما لم يقتض القانون المعمول به خلاف ذلك.
